Globally, indigenous people have sought repatriation of their cultural heritage and protection and control over their cultural resources. These are both tangible and intangible, and include spiritual sites, songs and stories, language itself, burial grounds, and ancestral remains. In the Western legal context, such resources are commodified and can be owned. As this volume points out, this practice conflicts with the indigenous concept of "owning as belonging," which emphasizes "transactions that strengthen relationships of respect and responsibility between people and what they regard as their cultural property." This study is a collaborative effort between scholars of the law, anthropology, archaeology, and First Nations (aboriginal peoples) in British Columbia and Alberta. Seven case studies treat indigenous concepts, the legal regime, and negotiations on cultural property between First Nations and Canadian governments. One essay surveys protection experiences nationally. Three chapters focus on aboriginal language, schooling, and heritage transactions. An important dimension of the book is presentation of data collected in discussion circles and from interviews with elders, ceremonial participants, spiritual leaders, and community members.
